As part of Landgate’s broader strata reform project, which saw amendments to the Strata Titles Act 1985 commence on 1 May 2020, Western Australia is poised to soon introduce a new form of land title, called Community Title.

‘Community Title’

Community schemes are being introduced to Western Australia through the Community Titles Act 2018.

A community scheme is a new form of land tenure in WA that will enable the subdivision of a single parcel of freehold land into multiple schemes, called ‘community titles schemes’.

Similar community title schemes are already in use in other states of Australia, including South Australia, Queensland and New South Wales. They should create new opportunities for mixed-use developments in WA.

Landgate and the Department of Planning, Lands and Heritage are currently working on finalising the regulations to support the Community Titles Act 2018.

The Community Title Act was assented to on 19 November 2018 and the draft Community Titles Regulations 2021 was advertised from 9 November – 9 December 2020.

The WA Planning Commission’s draft operational policy and accompanying guidelines consider what is assessed in a community development statement, as well as subdivision and development assessment.

These drafts are currently open for public comment through the Department of Planning, Lands and Heritage. Consultation closes on 27 April 2021.

Delivery of the final regulations and commencement of the new Community Titles Act 2018  is anticipated by mid-2021.
